Critical Rule

File Before You Disclose

Under the Patents Act, 1970, an invention that is publicly disclosed before filing may no longer be patentable. India provides a limited 12-month grace period only for disclosures at recognised exhibitions or in government publications. In all other cases: file first, disclose second.

Does my startup need a trade mark before launching?
Yes — filing before you use the brand publicly reduces the risk of someone else registering a similar mark first, and gives you priority rights from the filing date.
Can I patent something after I’ve already started selling it?
Generally no. Under the Patents Act, 1970, public disclosure — including sale, demonstration, or publication — before filing can permanently destroy novelty, except for India’s narrow 12-month grace period for recognised exhibitions or government publications.
Does copyright protect my product idea?
No. Copyright protects the expression of an idea — like your code, manual, or written content — not the underlying invention or process itself. For that, you need a patent or trade secret protection.
What reduced fees are available for MSMEs?
Registered MSMEs pay ₹1,750 for patent filing (vs. ₹8,800 for large companies) and ₹4,500 for trade mark filing (vs. ₹9,000). Register on the Udyam portal first to access these reduced fees.
What happens if I don’t renew my trade mark or patent?
Registered IP lapses silently if renewal fees aren’t paid on time — there’s often no reminder, and once lapsed, a competitor may be free to register the same or a similar mark.
